FACT SHEETS

Immigration Detention

Immigration Officers and the police have the power to arrest a person whom they believe has breached UK immigration law. Such arrests can be carried out upon arrival in the UK or at any time during a person's stay.

An arrest must be lawful - that is, it must be authorised under UK law. Officials must give written reasons for the arrest. The law requires officials to consider other alternatives, such as requiring a person to report regularly to the police/immigration officials, before carrying out an arrest. It is possible in most cases to apply for an arrested person to be released on bail.

A person who is arrested is entitled to free legal advice and representation. We charge for our services.

It is a criminal offence to give immigration advice and offer immigration services unless authorised to do so.
We are registered with the Office of the Immigration Services Commissioner (OISC) who audit and regulate our work.
All our immigration lawyers are registered at OISC Level 3, the highest level, allowing us to advise and represent on all aspects of UK immigration and nationality law without restriction.

Long Term Detention

We attend and represent people detained in the following Immigration Detention Centres:

  • Campsfield House Immigration Removal Centre
  • Colnbrook Immigration Removal Centre
  • Harmondsworth Immigration Removal Centre
  • Tinsley House
  • Oakington Immigration Reception Centre
  • Yarl's Wood

Because people in immigration detention have different situations and are at different stages of the immigration process, we cannot charge a set fee for attendance and representation for detained clients, as we do in all other cases.

Our charges are therefore a flat fee of £50 per hour, whether it is for travel time, waiting time, attendance upon clients and Home Office officials, writing representations and legal work on the case, or attending bail hearings before an Immigration Judge at the Asylum and Immigration Tribunal.

Airport Arrests

We attend and represent people detained at the following airports:

  • London Heathrow
  • Gatwick
  • Stansted
  • Luton

We charge a flat fee for attendance, advice and representation at the airport:

For calls received between 08:30 and 17:00 - £250
For calls received between 17:01 and 20:00 - £350
For calls received between 20:01 and 08:29 - £500
