Immigration DetentionImmigration Officers and the police have the power to arrest a person whom they believe has breached UK immigration law. Such arrests can be carried out upon arrival in the UK or at any time during a person's stay. An arrest must be lawful - that is, it must be authorised under UK law. Officials must give written reasons for the arrest. The law requires officials to consider other alternatives, such as requiring a person to report regularly to the police/immigration officials, before carrying out an arrest. It is possible in most cases to apply for an arrested person to be released on bail. A person who is arrested is entitled to free legal advice and representation. We charge for our services.
