Staying Legal

Entering or remaining illegally in the UK can have many serious consequences for an individual. If you are apprehended by the UK authorities you may be removed from this country, and this would have a negative impact on your 'immigration history', making it very difficult for you to be able to come back to the UK.

If you are currently in the UK and wish to remain beyond the date of your current visa, or to remain in some other category, you should apply to the Home Office to 'vary' your leave to be in the UK before your current visa expires. If your application is lodged after your leave to remain in the UK expires an application which may otherwise have been successful will be refused as you will have become an overstayer.

The rules on varying leave or 'switching' categories are very complicated, and it is not always possible to switch categories or to remain longer than permission was originally given for. Whether or not you will be able to vary your leave will depend upon your nationality, your current visa status and the law concerning both the category in which you are currently in the UK and the category into which you wish to switch. We strongly advise you to seek professional advice well before your current visa expires.
